1. Scope and seller
These Terms and Conditions apply to all orders placed by consumers or businesses through the online shop booknook.de.

Any different, conflicting or supplementary terms proposed by the customer will form part of the contract only if we expressly agree to them.
2. How the contract is formed
Products shown in the online shop are presented for information and do not constitute a legally binding offer.
By submitting an order, you make a binding offer to purchase the goods in your basket. A contract is formed when we accept your order, for example by sending an order confirmation by email or dispatching the goods.
3. Prices and delivery charges
Prices shown in the shop include any applicable statutory VAT or sales tax.
Delivery charges may apply. The applicable charge will be shown in the basket and at checkout before you submit the order. Further information is available in our Shipping Policy.
4. Payment
Available payment methods may vary according to the destination, basket and technical availability. They may include card payment, PayPal, Klarna, Apple Pay or other providers shown at checkout.
Payment is due when the contract is formed unless the checkout states otherwise.
5. Delivery
We deliver to the address you provide. Please check your delivery details carefully before completing the order.
Delivery times are estimates unless expressly stated to be binding. Delays may occur because of customs, local delivery services, public holidays or exceptionally high parcel volumes.
6. Ownership of the goods
The goods remain our property until payment has been received in full.
7. Cancellation rights and voluntary returns
Consumers may have a statutory right to cancel. In addition, we offer a voluntary return period of 60 days from receipt, as described in our Returns & Refunds Policy.
Our voluntary return period does not limit your statutory rights.
8. Your rights when goods are faulty
Your statutory rights in relation to faulty, damaged or incorrectly supplied goods remain unaffected by any voluntary service, replacement offer or returns policy.
If an item arrives damaged, faulty or incorrect, email service@booknook.de and, where possible, include clear photos or a short video so that we can review the issue promptly.
9. Liability
We do not limit liability for death or personal injury, or for loss caused intentionally or through gross negligence.
Where an essential contractual obligation is breached through ordinary negligence, liability is limited to loss that was typical and reasonably foreseeable for this type of contract. Essential obligations are those whose performance is necessary for the contract to operate as intended and on which the other party may normally rely.
Any further liability is excluded only to the extent permitted by law.
10. Governing law
French law applies. This does not deprive consumers of any mandatory protections granted by the law of the country in which they normally live.
11. Dispute resolution
We are neither required nor willing to participate in proceedings before a consumer dispute-resolution body.
12. Final provisions
If any provision of these Terms and Conditions is or becomes invalid, the remaining provisions will continue to apply.
